2. Service Description

CoolBits.ai is a software-as-a-service platform that provides AI-powered tools and assistants to help users with digital marketing, analytics, development workflows and related tasks. We may update or improve the Service over time, including adding, changing, or removing features.

The Service is not legal, financial, medical, or tax advice. You are responsible for how you use any output generated by the Service.

3. Accounts and Eligibility

You must be at least 18 years old to use the Service.

Access to the Service is provided via Google Sign-In (OAuth). When you sign in with Google, we receive basic account information (such as your email address) to create and manage your CoolBits account. You are responsible for:

• maintaining the confidentiality of your account and credentials;
• all activities that occur under your account.

We may suspend or terminate your account if we detect misuse, abuse, or violation of these Terms.

4. Plans, Billing, and Subscriptions

We currently offer:

• Starter – a free plan with limited usage (for example, an initial token allowance).
• Pro – a paid subscription plan that includes a higher usage allowance (for example, additional tokens per billing cycle).

Exact plan parameters (token amounts, limits, features) are described in the product interface and may change over time.

4.1. Payments and Stripe

Paid plans are billed through Stripe, our payment processor. By subscribing to a paid plan, you authorize Stripe to charge your chosen payment method according to the subscription terms shown at checkout. We do not store or process your full card details. Stripe handles card data and payment security.

4.2. Subscription Term and Renewal

Pro subscriptions renew automatically at the end of each billing cycle (e.g. monthly) unless you cancel before the renewal date. When a subscription is active, your account will be assigned the corresponding Pro plan and usage allowance (for example, a Pro token balance).

4.3. Downgrades and Cancellations

You can cancel your subscription using the Stripe billing portal or other cancellation options we provide. When your subscription is cancelled or expires:

• your account may be returned to the Starter plan;
• renewal charges will stop;
• your remaining usage allowance may be kept or adjusted according to the product policy in effect at that time.

Any changes to plan behaviour will be reflected in the product and/or these Terms.

4.4. Refunds

Unless explicitly stated otherwise, payments for subscription periods that have already started are non-refundable. We may, at our discretion, issue partial or full refunds in exceptional cases, but we are not obligated to do so.

5. Use of the Service

You agree not to:

• use the Service for any unlawful, harmful, or fraudulent purpose;
• attempt to bypass usage limits or security controls;
• probe, scan, or test the vulnerability of our systems without written permission;
• reverse engineer, decompile, or attempt to extract source code from the Service, except as allowed by mandatory law;
• use the Service to generate or distribute illegal content or content that violates the rights of others.

We may monitor aggregate usage, error rates, and abuse patterns to protect the Service and our users.

6. AI Content and Responsibility

The Service may generate content (text, code, or other outputs) based on your prompts and instructions. You are solely responsible for:

• reviewing and evaluating any generated content;
• ensuring that your use of the content complies with applicable laws and policies;
• not using generated content in high-risk situations where errors could cause harm.

We do not guarantee that AI outputs are accurate, complete, or suitable for any particular purpose.

7. Intellectual Property

The Service, including its software, design, logos, and branding, is owned by CoolBits or its licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business or personal purposes.

You retain ownership of your own content and data submitted to the Service. By using the Service, you grant us a limited license to process that content solely for the purpose of providing and improving the Service, as described in the Privacy Policy.

8. Data Protection and Privacy

Our processing of personal data is described in the Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

9. Service Changes and Availability

We may modify, suspend, or discontinue parts of the Service at any time, including introducing new limits or pricing, as long as we provide reasonable notice when required.

We aim for high availability but do not guarantee uninterrupted or error-free operation. Maintenance, updates, outages, and third-party issues may affect availability.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we:

• disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement;
• do not warrant that the Service will be free of errors, secure, or operate without interruption.

11. Limitation of Liability

To the maximum extent permitted by law, CoolBits, its affiliates, and its suppliers shall not be liable for:

• any indirect, incidental, consequential, special, or punitive damages;
• loss of profits, revenue, data, or goodwill,

arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to the Service shall not exceed the total amount you have paid for the Service in the 3 months preceding the event giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the Service or by email, where appropriate. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to its conflict of laws rules. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Iași, Romania, unless mandatory law provides otherwise.
